TACKMARKET EUROPE - TERMS AND CONDITIONS

These Terms and Conditions ("Agreement") govern your use of the TackMarket Europe website and services located at [https://tackmarket.eu] ("Site" or "Platform"), which is operated by TackMarket Europe ("we," "us," "our"). By accessing or using the Platform, you agree to be bound by these terms, and if you do not agree, you should not use the Platform. These Terms apply to all users of the Platform, including but not limited to buyers, sellers, and other visitors.

1. Eligibility

  • To use the services provided by TackMarket Europe, you must be at least 18 years old.
  • In some countries, users may be required to submit a valid photo ID to verify their age or identity before becoming a registered user.
  • By using the Platform, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

  • To access certain features of the Platform, you must create an account by providing accurate and up-to-date information.
  • You are responsible for maintaining the confidentiality of your account and password and for all activities under your account.
  • You agree to immediately notify us of any unauthorized use of your account.

3. User Responsibilities

  • Buyers: You are responsible for reviewing product details, terms of sale, and any applicable shipping or return policies directly with the seller before making a purchase.
  • Sellers: You agree to accurately describe your products, provide correct pricing information, and ensure that all products listed are legal to sell and in compliance with applicable laws.
    • You must always ship products with insurance and tracking to ensure both your protection and the buyer’s protection.
    • You are required to add the shipping cost for each shipping tier and country you wish to sell to.

4. Marketplace Transactions

  • Funds Holding: When a buyer purchases a product, TackMarket Europe will collect and hold the buyer’s funds. The funds will remain held until the buyer has received the product and has not reported any issues within 3 days of receipt.
  • Funds Release: Once the 3-day period has passed without any issues being reported, the seller’s funds will be released to their wallet on the Platform.
  • Withdrawals: Sellers can withdraw available and cleared funds to their Bank Account via the platform’s withdrawal process.

5. Disputes and Resolution

  • Dispute Handling: In the event of any issues or disputes between the buyer and seller (e.g., product not received, product not as described, etc.), TackMarket Europe will manage the dispute process. The Platform’s decision regarding the dispute is final.
  • Both buyers and sellers are required to cooperate with the dispute resolution process and provide necessary documentation or information when requested.

6. Seller Shipping Requirements

  • Shipping Insurance and Tracking: Sellers must ship products with both shipping insurance and tracking to protect themselves and the buyer. Failure to do so may lead to the seller being held liable for any lost, damaged, or undelivered items.
  • Shipping Costs: Sellers are required to specify shipping costs for each shipping tier and country they wish to sell to, ensuring buyers are aware of the full cost of delivery.

7. Fees and Payments

  • Some services on the Platform may be subject to fees, which will be clearly disclosed before the completion of a transaction.
  • Buyers and sellers are responsible for their respective payment arrangements. We may use third-party payment processors to facilitate payments.
  • TackMarket Europe does not store payment details or process payments directly.

8. User-Generated Content

  • Any content you upload to the Platform (such as product listings, reviews, etc.) remains your property, but you grant TackMarket Europe a worldwide, royalty-free, non-exclusive license to use, display, and distribute the content for purposes related to the operation of the Platform.
  • You are responsible for ensuring that all content you upload complies with applicable laws, including intellectual property laws.

9. Privacy and Data Protection

  • Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, store, and process your personal data. Please review the Privacy Policy for more details.
  • TackMarket Europe complies with applicable data protection laws, including the General Data Protection Regulation (GDPR).

10. Limitation of Liability

  • TackMarket Europe does not guarantee the accuracy, reliability, or completeness of the content on the Platform. We are not liable for any errors, interruptions, or damages caused by your use of the Platform.
  • You use the Platform at your own risk, and our liability is limited to the maximum extent permitted by applicable law.

11. Termination

  • We reserve the right to suspend or terminate your account if we believe you have violated these Terms and Conditions or for any other reason, at our sole discretion.

12. Amendments to Terms
